The Regulatory Framework
- Nigerian communications legislation requires licensed telecommunications operators, including MVNOs, to maintain a capability to intercept communications in response to lawful orders from authorised law enforcement agencies (LEAs).
- The Nigerian Communications Commission (NCC) sets technical and operational requirements for lawful intercept capability as part of its licensing framework.
- Lawful intercept requests must be made through legally prescribed processes and are subject to applicable Nigerian law. Operators may not act on requests that do not comply with the prescribed legal process.
- MVNOs are responsible for ensuring their platform provides the required lawful intercept capability. This obligation does not transfer to the host MNO.
Platform Handling
How MCX Handles Lawful Intercept
MCX provides a lawful intercept capability at the platform layer via the Latro integration. The technical architecture and operational procedures for lawful intercept on the MCX platform are documented and disclosed to MVNOs under a mutual non-disclosure agreement as part of the Launch Path programme.
Specific configuration details, intercept interfaces, and operational procedures are not disclosed publicly. MVNOs requiring this information for compliance purposes should raise it in the scoping call.

What This Means for MVNOs
- The MVNO, as the NCC licence holder, is the entity responsible for compliance with lawful intercept obligations. MCX provides the capability at the platform layer; the MVNO holds the regulatory obligation.
- MVNOs should designate a point of contact for lawful intercept matters and establish an internal process for receiving and acting on lawful intercept orders through legally prescribed channels.
- MVNOs must not disclose lawful intercept capability details, active intercept orders, or intercept-related communications to third parties or to the subject of an intercept without legal authority to do so.
